Twenty-one Hamas ministers and Legislative Council members from the Reform and Change list arrested by Israeli authorities last June are to remain behind bars following an Israeli court decision to extend their detention. On September 25, an Ofer military appeals court accepted an appeal by the State of Israel against the release of 21 Palestinian legislators after previously ordering their release on bail.

The arrests began on June 30, just days after the capture of Israeli Corporal Gilad Shalit in a Gaza Strip operation. Eight ministers and 24 PLC members were rounded up by Israeli authorities on the basis of being members of a “terrorist organization” including PLC Speaker Aziz Dweik and Jerusalem Affairs Minister Khalil Abu Arafeh. The lawmakers have refused to recognize the legitimacy of the court, saying their arrests were politically and not security-oriented and were made on completely unjust bases.

The detainees’ attorney, Jawad Bulus, called the decision, “unsurprising, unfortunate and unjust,” saying that this can only be seen as a “slap in the face.”

By arresting and keeping these ministers and parliamentarians behind bars, Israel is not only disregarding these lawmakers’ political immunity but is sending a dangerous message that no Palestinian is exempt from Israel’s arbitrary justice system. If Israel deems them a “threat” of any kind, every Palestinian regardless of their political affiliations or status may be subjected to arrest and kept behind bars indefinitely.
