The Palestinian Initiative for the Promotion of Global Dialogue and Democracy (MIFTAH) condemns the current Israeli land grab in east Jerusalem and calls for its immediate halt. Today, MIFTAH’s Secretary-General Dr. Hanan Ashrawi filed a complaint at the American Consulate in east Jerusalem, warning of the serious repercussions that could follow in light of the Israeli government’s reimplementation of the highly racist ‘Absentee Property Law.’

The Israeli cabinet adopted the decision in 2004, which was neither made public nor even published, to east Jerusalem, thereby confiscating thousands of dunams of land from Palestinian owners living in the West Bank. The alleged reason for the decision was security-related. Since West Bank residents are barred from entering east Jerusalem because of Israeli security measures imposed during the Intifada, the cabinet decided to enact an official measure that would prevent any use of these lands by their owners in the future, and would explicitly state that henceforth their property belongs to the State of Israel.

Although the legitimate owners live a short distance away from their confiscated property, their names and addresses are very well known, which prove their rightful ownership. Still, the Israeli cabinet decided to label them “absentees” and apply the law, which enabled the State of Israel to be created and expand at an utterly unnatural rate. There are many factors that will lead the Palestinian side to doubt this cabinet’s real intent with concerns to peace. This highly racist policy comes at a time of supposed and gradual resumption of negotiations and/or co-operation between the PNA and Israel. Even more disturbing is the fact that this policy is being perused while the international community hails and awaits the proposed ‘Unilateral Disengagement Plan’ as a positive development. Former Justice Minister and the leader of the Yahad party Yossi Beilin, equated this policy to property theft.

This latest imposed policy by the State of Israel comes in contravention to international law of which Israel is a high contracting party, in specific to the fourth Geneva Convention, articles 53, 114, and 147. The articles state that, “Any destruction and/or confiscation by the occupying power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited.”

Hence MIFTAH, calls on the international community not to stand idle but rather take unequivocal measures to stop the State of Israel from this immoral theft of land.
