In Response to an Appeal Submitted by PCHR, Israeli High Court Gives the Israeli Prosecution One Day to Explain Reasons for the Demolition of 6 Palestinian Houses

In response to an appeal submitted by PCHR, on Tuesday morning, 28 September 2004, the Israeli High Court gave the Israeli prosecution one day to further explain claims which it had cited to justify the demolition of 6 Palestinian houses in Sheikh 'Ejlin neighborhood in Gaza City.

On Monday evening, 27 September 2004, PCHR submitted an appeal to the Israeli military legal advisor after residents of the six houses had been verbally informed by Israeli occupying troops that their houses would be demolished. In response to PCHR's appeal, the Israeli military legal advisor claimed that there was no intention to demolish the six houses.

Residents of the six houses vacated them when they received the demolition notices, but came back to the houses when Israeli occupying troops cancelled the demolition order. The houses belong to Shehada Ahmed 'Awad and his five sons: Suhail; Mahmoud; Ahmed; Rasmi; and Akram.

However, according to information reported by PCHR's field workers, late at night on Monday, 27 September 2004, Israeli troops again ordered residents of the six houses to vacate them as they would demolish them on Tuesday early morning, 28 September 2004. Residents of the houses vacated the houses again.

On Tuesday early morning, PCHR submitted an appeal against the demolition order to the Israeli High Court. In the conclusion of the session held to consider PCHR's appeal, the Israeli High Court gave the Israeli prosecution one day to explain its claims regarding the discovery of a tunnel under one of those houses, including its length, direction and its relations with other houses.

Since the beginning of the current Intifada on 29 September 2000, 2432 Palestinian houses, including 277 flats in apartment buildings, have been totally demolished and 2379 others have been partially demolished in the Gaza Strip by Israeli occupying troops.

PCHR is worried that Israeli troops may demolish the six houses, rendering their 25 residents homeless. PCHR calls upon concerned international bodies to intervene to the stop the policy of house demolition practiced by Israel in the Occupied Palestinian Territories.
