Al-Haq strongly condemns the gross violations of international law displayed once again by Israeli authorities in the extra-judicial killings and targeted assassinations of Mohammed Liftawi, Salam Ya'qoub, and Nasser Jawabra, members of the Al-Aqsa Brigade on 21 November 2004.

Initial reports received by Al-Haq indicate that between 6-7 p.m, a BMW carrying the three Palestinians was travelling near the Industrial Zone on the road to Betunia, near the West Bank city of Ramallah. On the main street opposite the al-'Attari fuel station, the car was passed by an unmarked car; the vehicle appeared to have three civilian Palestinians, later identified as disguised members of an Israeli undercover military unit. Shortly prior to the incident, another group of undercover soldiers reportedly made it into the nearby 'Ali al-Hatab's bakery, and held up all those inside, whilst several Israeli military jeeps surrounded the area.

Israel’s undercover agents simultaneously shouted at the Palestinians to stop the car, and discharged a barrage of indiscriminate fire from their automatic weapons towards the vehicle. The Palestinians were hit in the head, chest and neck areas, strongly suggesting that the Israeli forces did not try to apprehend the suspects, but instead intended to kill them. After this initial assault, Israeli agents descended from the car and opened fire once again at the bodies of the Palestinians. None of the victims managed to leave the car.

Under international human rights law, even if persons are suspected of being involved in criminal activity, governments are obliged to exhaust all other available measures to arrest them and bring them to trial. According to international human rights instruments, such as the International Covenant on Civil and Political Rights, a person’s inherent right to life cannot be derogated from, even "in time of public emergency which threatens the life of the nation" [emphasis added]. Therefore Israel can not justify its targeted assassination policy in the name of security or counter-terrorism measures. In addition, willful killing of this nature is a war crime, and constitutes a grave breach of the Fourth Geneva Convention, which mandates universal jurisdiction.

In the past, Al-Haq has warned repeatedly of the existence of a deliberate and consistent policy of such killings on behalf of Israeli political and military command structure. In addition, numerous reports by human rights organizations have warned about the continued operation of undercover units in the Occupied Palestinian Territories (OPT) with the full endorsement of Israeli officials. Their actions violate both international norms governing the use of lethal force, and the rules of engagement that the Israeli army claims to be applying in the OPT, as well as grants them the ability to do so with virtual impunity.
