On Thursday 3 February, the Palestinian Legislative Council (PLC) adopted, in its first reading, the new Palestinian draft Electoral Law. PLC members debated a number of articles that raised differences between them concerning the type of electoral system, the distribution of seats in the coming PLC, the representation of women, and the right of public officials to run for office in the PLC. None of these issues were finalized at this session and they were all transferred to coming sessions.

The PLC's first reading was closed following the omission of all articles concerning quotas for women, the adoption of a mixed electoral system, relative representation with the Occupied Palestinian Territories (OPT) as a single constituency and the multiple constituency system. It was decided that the number of PLC members would be raised to 132, one third of whom are to be elected according to the relative representation system with the entire OPT as a single constituency. The rest of the seats, 88 seats, are to be elected in separate constituencies. Additionally, the Council also set 2% as the minimum percentage of votes for any political group to win a seat in the PLC.

The Council rejected two amendments to reduce the age of candidates to 25 and 28 years old, and adopted 30 as the age at which people become eligible for candidacy.

Al Mezan Center for Human Rights commends the adoption of the mixed electoral system in principle. However, it finds the assignment of one third of seats for the relative representation system insufficient, as this does not remedy the many problems the old system caused.

The Center believes that the adopted draft does not constitute a sufficient resolution of the current political crisis, which necessitates maximum participation and true representation of the political powers and adequate representation for women in the PLC. Al Mezan criticizes the rejection of a women’s quota, which limits the prospects for fair participation of women in the Palestinian community. This decision is especially questionable after the PLC's ratification of the quota system in the Palestinian local elections.

The omission of the above mentioned recommendations, which were introduced by the Legal Committee in the PLC, constitutes a step backward, and a contradiction of the attitude the PLC has shown in the past in the process of developing a modern and fair electoral system. As such, Al Mezan wishes to introduce the following suggestions to the PLC and the Palestinian community:

  • That equal distribution of PLC seats, i.e. 50% for constituencies and 50% for relative representation, is ensured to encourage fair participation and maximum representation of political powers.
  • That adoption of the quota system for women, which was set to ensure representation of 20% for women in the coming PLC, is reconsidered in the second reading of the draft law.
  • That the age of 25 is ratified as the minimum age for people wishing to run for PLC membership so as to support participation of a younger generation.
  • That the minimum percentage of votes is reduced to 1.5% of total votes to ensure wider political representation in the PLC.
