Open Letter to UN Secretary-General Kofi Annan:
UN Must Not Condone Israeli Violations of International Law


Dear Secretary-General Annan,

Al-Haq, a Palestinian organisation dedicated to the protection and promotion of human rights and rule of law in the Occupied Palestinian Territories (OPT), notes with grave concern your recent comments regarding the Israeli policy of house demolitions in the OPT. On 25 June, you noted that while you are aware of the serious violations to which Palestinians are subjected, and while you have spoken out about them, you did not believe that action would be taken by the international community to stop these violations. In particular, you stated,

…You would want to see immediate action by the Quartet to either stop the demolition of the houses, and that is going to take the kind of action and will and resources and confrontation that, quite frankly, today I don't see anybody on the international community willing to take. And you know that. And so - and I cannot, as Secretary-General, move in. I don't have troops. I don't have horses. And I don't think the Governments are prepared to do the kind of thing that you are indicating.

While we appreciate your political candour, we find your presentation of the situation deeply troubling. As a Palestinian organisation on the ground, we are well-aware of the international laissez-faire regarding the protection of the Palestinian people. Al-Haq has regularly denounced this position as an abdication of nation states' obligations under international law. It is clear that without respect and enforcement of international law by the global community, Israeli violations will continue, as they have for decades. We believe that the United Nations (UN), as a organisation whose Charter is one of the foundations of international human rights law and which has amongst its primary purposes the promotion and protection of human rights, must speak out against governmental inaction rather than accept it. On the same day you issued this statement, the UN's own experts issued a joint statement strongly condemning the continuing violations of human rights and fundamental freedoms in the OPT. Their statement is clear: the human rights situation in the OPT is grave. They note that Israeli authorities subject Palestinians to such practices such as targeted killings, excessive use of force during military incursions, arbitrary and long periods of incommunicado detention, torture and other forms of inhuman and degrading ill-treatment, house demolitions, property destruction, land confiscation, and movement restrictions.

In light of the gravity of the situation in the OPT, we believe that the UN must challenge state inaction, rather than concede to it. Every Palestinian is affected on a daily basis by such violations, and it touches on every aspect of their daily lives, restricting such fundamental rights as those to food, housing, water, health, education and work, many of which were referenced in the recent World Bank report on the Palestinian economy. Given the widespread impact of Israeli practices, the UN must actively speak out against state inaction. To do otherwise is to undermine its own commitment to human rights and rule of law and to condone governmental violations of international law.
